What Is Seller Disclosure (ORS 105.464 / 105.475)?
Definition
Oregon's seller disclosure statement (ORS 105.464) requires a home seller to answer, to their actual knowledge, whether work was done on the property, whether a permit was required, and whether a final inspection was obtained — disclosed on a standardized state form before closing.
Why it matters for your home
Disclosed unpermitted work scares off buyers, lenders, and insurers; undisclosed unpermitted work that surfaces later can let a buyer revoke the sale within five business days under ORS 105.475 — either way, the inexpensive permit at install time is far less costly than the alternative.
What to do about it
If you're planning to sell within the next several years, resolve any known unpermitted HVAC or electrical work now rather than at closing, when options and negotiating leverage are both worse.
